Terms and Conditions Dutch Translation Agency

 

  1. The deadline specified in the quotation can only be achieved when the Dutch Translation Agency or Vertaalbureau Roosendaal has received all the required data for the specific project in time.
  2. The Dutch Translation Agency or Vertaalbureau Roosendaal is indemnified against third party claims due to alleged violation of property-, patent-, copyright or other intellectual property rights related to the execution of the agreement.
  3. The client remains responsible for all services taking place in the name of the client and indemnifies the Dutch Translation Agency or Vertaalbureau Roosendaal from third party claims.
  4. The Dutch Translation Agency or Vertaalbureau Roosendaal uses third parties which are not in his permanent employ. If the project is performed by a third party which is not in the permanent employ of the company, the Dutch Translation Agency or Vertaalbureau Roosendaal shall not be liable for damages suffered by the client in case of an attributable shortcoming. In this case, the third party shall be fully responsible.
  5. The Dutch Translation Agency or Vertaalbureau Roosendaal is never responsible for any form of damage such as injury, loss of profit, losses due to delays and loss of income.
  6. The evaluation of the question whether a project performed or to be performed by the Dutch Translation Agency or Vertaalbureau Roosendaal involves certain risk of injury is completely for the account and risk of the client.
  7. The client who acts in contradiction to his obligations from the agreement or these general terms and conditions is responsible for all losses suffered by the Dutch Translation Agency due to this.
  8. The size of the Dutch Translation Agency’s liability per project does not exceed its fee less the out-of-pocket costs related to the delivery. The client waives his right to claim dissolution based on breach of contract of the arrangements agreed on.
  9. In case of force majeure at the Dutch Translation Agency (or Vertaalbureau Roosendaal) or a third party who is not permanently employed, the client’s obligations shall be suspended. The client will be informed about this as soon as the Dutch Translation Agency or Vertaalbureau Roosendaal becomes aware of the nature of the particular delay. The Dutch Translation Agency or Vertaalbureau Roosendaal is then entitled to charge for the part of his responsibilities performed and the client is obliged to pay this invoice.
  10. The client must report visible defects to the works delivered or supplied immediately after the Dutch Translation Agency or Vertaalbureau Roosendaal delivered it, or at least within 15 days after delivery. The submission of a complaint does not influence the client’s other obligations.
  11. If a complaint about services and/or goods delivered appear to be founded and it is discovered that the Dutch Translation Agency or Vertaalbureau Roosendaal is responsible for it, he shall pay a fee that does not exceed the invoice value of the services minus the out-of-pocket costs related to the goods and/or services supplied. The Dutch Translation Agency is never obliged to pay any further compensation for damages.
  12. The Dutch Translation Agency or Vertaalbureau Roosendaal never accepts responsibility for shipping delays, damages or loss of documents.
